Welcome to AI Stock Analyzer ("we," "our," or "us"). By accessing or using our website at https://aistockanalyzer.org and our related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. ELIGIBILITY AND AGE REQUIREMENTS

By creating an account, accessing, or using the Service, you represent and warrant that you are at least 18 years of age (or the age of legal majority in your jurisdiction). You must have the legal capacity to enter into a binding contract with us. If you are under 18, you are strictly prohibited from using the Service. We reserve the right to terminate your account without notice or refund if we discover you have misrepresented your age.

2. NO FINANCIAL OR INVESTMENT ADVICE (CRITICAL DISCLAIMER)

2.1. Educational and Informational Purposes Only: The Service, including all reports, target prices, "BUY/SELL/WAIT" verdicts, confidence scores, and AI-generated text, is provided for strictly educational and informational purposes only. WE ARE NOT REGISTERED INVESTMENT ADVISORS, BROKERS, OR DEALERS.

2.2. No Fiduciary Relationship: Nothing generated by the Service constitutes financial, legal, tax, or investment advice. You alone assume the sole responsibility of evaluating the merits and risks associated with the use of any information generated by the Service before making any decisions based on such information.

2.3. Assumption of Risk: Financial markets are inherently risky. You acknowledge that you can lose some or all of your money. We are not responsible for any financial losses or damages you may incur based on the outputs of our Service. You must conduct your own due diligence or consult with a licensed financial professional.

3. ARTIFICIAL INTELLIGENCE AND DATA LIMITATIONS

3.1. AI Hallucinations: The Service utilizes advanced Large Language Models (LLMs) to parse data and generate reports. You acknowledge that AI technology is experimental and prone to errors, omissions, and "hallucinations" (generating plausible but entirely false information).

3.2. Third-Party Data Accuracy: Our Service fetches raw data from third-party APIs (e.g., SEC EDGAR, Yahoo Finance, FMP). We do not guarantee the accuracy, completeness, timeliness, or availability of this raw data.

3.3. "AS-IS" Basis: All reports are provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind.

4. USER-UPLOADED CONTENT AND CONTEXT

4.1. Responsibility for Anonymization: The Service allows you to upload custom documents (e.g., PDFs) to personalize your AI reports. YOU AGREE NOT TO UPLOAD DOCUMENTS CONTAINING SENSITIVE PERSONAL IDENTIFIABLE INFORMATION (PII), including but not limited to Social Security Numbers, passport numbers, full bank account numbers, or home addresses.

4.2. Processing of Uploads: You acknowledge that the text extracted from your uploaded files will be transmitted to our third-party AI providers (e.g., Anthropic, Google) for the sole purpose of generating your report. You are solely responsible for redacting confidential information prior to upload.

5. ACCOUNTS AND CREDITS (PAYMENTS)

5.1. Merchant of Record: Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns regarding billing.

5.2. Credit System: The Service operates on a pay-as-you-go credit system. Credits are used to generate AI reports.

5.3. No Refunds: Due to the non-returnable nature of API computing costs incurred the moment a report is generated, ALL SALES OF CREDITS ARE FINAL AND NON-REFUNDABLE. If a report generation fails due to a system error on our end, your credit will not be deducted, or we will manually restore it upon review. We do not offer refunds if you disagree with the AI's verdict or analysis.

5.4. Account Security: You are responsible for safeguarding your password. We are not liable for any unauthorized use of your account.

6. ACCEPTABLE USE AND RESTRICTIONS

You agree NOT to:

• Reverse engineer, decompile, or attempt to extract the source code or AI prompts of the Service.
• Use automated scripts, bots, or scrapers to access, copy, or mass-generate reports.
• Resell, redistribute, or commercially exploit the reports generated by the Service as your own licensed financial advice.
• Share your account credentials with multiple users.

7. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AI Stock Analyzer OR ITS CREATORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR LOST PROFITS RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless AI Stock Analyzer from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Service or your violation of these Terms.

9. DISPUTE RESOLUTION AND CLASS ACTION WAIVER

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration on an individual basis. YOU AGREE TO WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

10. CHANGES TO THE TERMS

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes your acceptance of the revised Terms.
